The Memo: DOJ targets Trump foes in flurry of activity in election’s shadow
The raid on Eric Swalwell's home, a week before the midterms, is the kind of story that gets read through a partisan lens before the facts are in. I don't know what the investigation is about, and neither do most people commenting on it. That's the problem with law enforcement actions landing in an election window, they become ammunition regardless of intent.
I think the DOJ has a genuine dilemma here. It can't pause all politically relevant investigations for fear of looking partisan, but it also knows that a single search warrant can shift a race. The Swalwell case is especially delicate because he's been such a visible Trump critic, so the optics are almost guaranteed to be inflammatory.
What I'd want to know is how the decision to move this week was made. Was there a legitimate evidentiary deadline, or was this a choice to act before the election rather than after? The department's track record on independence has been questioned from both sides this year, and this won't settle that argument.
I land on this: the timing is either a coincidence or a choice, and the DOJ owes the public a clear explanation either way. Without that, every voter is left to fill in the blanks with their own suspicions.
